Terms and Conditions of Use

1. Introduction

Welcome to the Ru'ya Al-Akar application, the integrated digital platform for real estate services. It brings together real estate offices, marketers, and business users; provides them with real estate services; and helps every user access those services securely—whether or not they subscribe to a package. The platform also offers distinctive features that support effective remote communication through property voice councils.

These Terms and Conditions govern use of the application and the services provided through it. Please read them carefully before registering or using the services.

By creating an account or using any service, the user agrees to comply with these Terms, subject to the rights and obligations set out under applicable laws and regulations in the Kingdom of Saudi Arabia.

2. Definitions
Application: The Ru'ya Al-Akar application and its related services and features.
Operator: The legal entity responsible for operating the application, as specified in its official details.
User: Any person who uses the application, whether an individual, real estate office, marketer, or business user.
Services: Real estate services, listings, subscriptions, auctions, voice rooms, and other available features.
Subscriber: A user who subscribes to one of the paid packages.
Content: Listings, images, information, documents, messages, and other materials provided by users.
3. Registration and Account Creation
The user must provide accurate, correct, and up-to-date information.
The user is responsible for safeguarding login credentials and not sharing them with others.
The account must be used for lawful purposes; impersonating others is prohibited.
Documents may be requested to verify identity, professional status, or eligibility to provide a particular service, as required by law.
Accounts must not be created or data submitted for fraud, misleading others, or circumventing application rules.
4. Services Provided by the Application
Depending on enabled and available services, Ru'ya Al-Akar may provide:

Publishing and browsing real estate listings and offers.
Enabling offices and marketers to showcase services and communicate with clients.
Subscription packages for offices, marketers, and business users.
Real estate auctions subject to applicable legal controls and licensing.
Interactive voice rooms under the name “Remote Culture” (Thaqafa ‘an Bu‘d) for knowledge sharing and communication.
Featured advertising and visibility/interaction benefits according to subscription type.
Additional technical features as announced in the application.
Each service is subject to its own terms where they exist. A service is available only if it is enabled and published within the application.

5. User Obligations
All users must:

Use the application in accordance with applicable laws in the Kingdom of Saudi Arabia.
Provide accurate information and not publish misleading listings or offers.
Respect others’ rights, privacy, and intellectual property.
Not use the platform for fraud, threats, defamation, or harm to others.
Not attempt to hack the application, disrupt its services, or access its data without authorization.
Not misuse user data for unlawful purposes.
Comply with the terms of subscriptions and services they request.
6. Real Estate Listing Terms
The advertiser is responsible for the accuracy of listing information, including property description, photos, location, price, and other material details.

The advertiser must also:

Have the legal right to publish the listing or obtain the necessary authorization.
Hold the licenses and permits required for the listing type or real estate activity.
Not publish fake properties, misleading information, or incorrect documents.
Update the listing when material information changes or the listing purpose ends.
Not publish others’ data or images without a lawful basis.
The operator may review listings, request changes, suspend them, or remove them when there are legitimate grounds or suspicion of breach of law or these Terms.

7. Real Estate Offices and Marketers
Offices and marketers must use the platform within the scope of their status, authority, and licenses required for their activity.

They are responsible for the accuracy of published data, the lawfulness of listings and services offered, and obligations arising from dealings with clients.

Subscription to the application does not replace obtaining licenses or permits required by law to conduct real estate activities.

8. Subscriptions and Paid Packages
The platform offers various subscription packages; benefits and fees differ by category and the services defined for each package.

Before completing subscription, the user is shown package details, fees, duration, benefits, and terms for renewal, cancellation, and refund.

The subscriber must pay the announced fees for the services selected. Subscription does not guarantee sales, completed deals, or a specific number of clients, unless there is an explicit written commitment to the contrary.

Fees for an existing subscription may not be changed with retroactive effect. Any future fee changes and how they apply will be explained before they take effect, in line with legal requirements.

Benefits of each package are defined in its description within the application or in the relevant subscription agreement.

Voice Rooms
Participants must treat each other with respect and must not use the rooms to publish content that violates the law, infringes others’ privacy, or involves fraud or misleading advertising.

Conversations must not be recorded, republished, or used in a way that violates participants’ rights or applicable law.

Featured Listings and Points System
Some packages may offer benefits to increase listing visibility or boost voice room ranking according to the points mechanism used in the application.

How points are calculated, used, and limited is set out in the service description or package terms. These benefits do not guarantee completion of a deal or any specific commercial outcome.

Real Estate Auctions
Auctions available through the application are subject to the published auction terms, including property description, participation requirements, bidding mechanism, schedules, and award, payment, and cancellation conditions.

Participants must read the terms of each auction and verify required information and documents before placing any bid.

An auction that requires a license may not be organized or managed until the necessary licenses and legal requirements are met. The responsible party for the auction and the platform’s role in it will be clarified.

Dealings Between Users
The platform may allow users to communicate about properties, services, and business opportunities.

Each party is responsible for verifying information, credentials, authority, and required documents before entering any agreement or paying any amount.

Contracts between users are governed by their own terms and applicable law. These general Terms do not replace formal contracts required by law.

14. Role of the Platform and Limitation of Liability
The application’s function is the technical and real estate services announced in it. The operator’s role in each service is defined according to its nature and relevant contracts and legal obligations.

Publishing a listing or enabling communication between users is not a guarantee of the accuracy of all information provided by advertisers, or of completing a deal or achieving profit.

This clause does not exempt the operator from responsibilities and obligations imposed by law or expressly assumed by the operator.

15. Content and Intellectual Property
Intellectual property rights in the application name, logo, design, interfaces, and software belong to the rights holder or its licensee.

Users retain rights in content they own and grant the operator permission to display and use that content as needed to provide and operate the service, in accordance with the Privacy Policy and applicable law.

Application elements may not be copied, republished, or commercially exploited without permission or a lawful basis.

16. Privacy and Data Protection
Personal data collected or processed through the application is subject to the Ru'ya Al-Akar Privacy Policy and applicable laws in the Kingdom of Saudi Arabia.

17. Account Suspension or Service Discontinuation
The operator may take appropriate measures—including restricting certain services, suspending an account, or removing violating content—when there are legitimate grounds, such as breach of these Terms, suspected fraud, or a lawful request.

Procedures and rights under law will be respected, including notice or an opportunity to object where required.

Account suspension does not release the user from existing financial or contractual obligations that continue under the contract and applicable law.

18. Service Availability and Updates
Some services may require maintenance or technical updates; availability may be temporarily affected for technical or operational reasons.

The operator seeks to improve service stability and continuity, subject to its legal and contractual obligations.

19. Complaints and Inquiries
Users may submit inquiries or complaints through official contact channels announced in the application.

Requests are handled according to approved procedures, with respect for user rights and the legal jurisdiction of competent authorities.

20. Amendments to the Terms and Conditions
These Terms may be updated when services are developed or legal requirements change. The updated version will be published with the date of the last update. Users will be notified of material changes and asked for required consents where applicable.

21. Governing Law
These Terms and Conditions are governed by applicable laws in the Kingdom of Saudi Arabia and interpreted accordingly, with regard to the jurisdiction of competent regulatory and judicial authorities.
